About Us The Websites are operated by Interflora British Unit. We are registered in England and Wales under company number 00297087 and have our registered office at Interflora House, Watergate, Sleaford, Lincs, NG34 7TB. Our VAT number is 853125735. These Terms of Use govern your use of the Websites and the Service. Use of the Service and the Websites Use of the Service is intended to assist with purchases to be made via local Interflora stores ('Our Florists'). The Service must not be used for the following purposes:
a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
b) gaining unauthorised access to other computer systems. Interflora reserves the right to refuse to post material on the Websites, or to remove material already posted on the Websites. Accessing our Sites Access to the Websites is permitted on a temporary basis, and we reserve the right to withdraw or amend the Service without notice. We will not be liable if for any reason our Websites are unavailable at any time or for any period. We aim to update our Websites regularly, and may change the content at any time. If the need arises, we may suspend access to our Websites, or close them indefinitely. If we have reason to believe that there is likely to be a breach of security or misuse of the Service or Websites, we may suspend use of the Service. Any of the material on our Websites may be out of date at any given time, and we are under no obligation to update such material. You are responsible for making all arrangements necessary for you to have access to our Websites. You are also responsible for ensuring that all persons who access our Websites through your internet connection are aware of these Terms of Use, and that they comply with them. Intellectual Property Rights We are the owner or the licensee of all intellectual property rights in our Websites, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not modify the materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the owners or licensees of material on our Websites must always be acknowledged. You must not use any part of the materials on our Websites for commercial purposes without our consent. If you print off, copy or download any part of our Websites in breach of these Terms of Use, your right to use our Websites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. Our Liability Whilst we take every reasonable precaution and care in relation to the Service, we do not make any representation or warranties of any kind (express or implied) with respect to the contents or operation of the Service or Websites. Whilst we agree to use our reasonable endeavours to ensure that the Websites and/or the Service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the Websites and/or the Service and shall be released from our obligations under these Terms of Use in the event of any cause beyond our reasonable control which renders the provision of the Websites and/or the Service impossible or impractical. Your use of the Service is done so entirely at your own risk. We exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Websites and/or the Service, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms of Use affects or will affect your statutory rights as a consumer. To the extent permitted by applicable law, our total aggregate liability to you for all and any damages, losses or causes of action arising, by reason of or in connection with your use of the Websites and/or the Service, shall be limited to £1 million. These Terms of Use do not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law. Information about you and your visits to our Websites We do not collect any of your personal identifiable information at the florists.interflora.co.uk and florists.interflora.ie websites. Viruses, Hacking and other Offences You must not misuse our Websites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Websites, the server on which our Websites are stored or any server, computer or database connected to our Websites. You must not attack our Websites via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you may be committing a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Websites will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Websites or to your downloading of any material posted on it, or on any websites linked to it. Linking to our Website You may link to our home pages, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any websites that is not owned by you. Our Websites must not be framed on any other site, nor may you create a link to any part of our Websites other than the home pages. We reserve the right to withdraw linking permission without notice. Links from our Websites Where our Websites contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those third party sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. Jurisdiction and Applicable Law The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our Websites although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law. Variations We reserve the right to supplement and amend these Terms of Use from time to time. We will post any changes on our Websites and it is your responsibility as a customer to review the Terms of Use on each occasion you access the Service or Websites. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions. Alcohol Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor. It is an offence under Sections 32 and 33 of the Intoxicating Liquor Act 1988 (Ireland) for any person under 18 to buy, or attempt to buy, intoxicating liquor. It is an offence under Licensing (Northern Ireland) Order 1990 for any person under 18 to buy, or attempt to buy, intoxicating liquor. Delivery Services Should you require your delivery to be made within a specific time period (this is only available for certain product ranges) our florists are able to offer the following delivery services for a small additional fee:- Same Day delivery; 'Before 1pm'/'after 1pm' service. The service is offered to flower orders for delivery within the UK, Ireland, Isle of Man and Channel Islands. Should you require this delivery service, your Order must be received (requesting this service) by 1pm 24 hours in advance of the required delivery date (1pm Saturday in the case of Monday deliveries). This delivery service is offered subject to availability and is not available for certain products . the service may be withdrawn without notice during busy periods. '3 hour delivery' service is available at a charge of £6.00/€8.70. The service is offered for flower orders to selected delivery locations within the UK, Ireland, Isle of Man and Channel Islands. Should you require this delivery service, your Order must be submitted requesting this service. This delivery service is offered subject to availability and is not available for certain products . the service may be withdrawn without notice during busy periods. In the case of delivery to certain locations where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. Please be advised that we are unable to deliver wines, and plants to Funeral Directors, Hospitals, airports or ships. Please note that the florist is only responsible for delivering against signature to the address you quote (or an imminent neighbour if no one is at home) we regret that where the goods have been correctly delivered we can not accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual received refuses or fails to return item(s). Where the florist is unable to find someone to accept delivery they will either deliver to a neighbour or leave a card at the address for the recipient to make contact. Comments / Queries

General These Terms of Use shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Websites, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms of Use shall prevail. If any of these Terms of Use are held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms of Use and as stated in our Privacy Policy. A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms of Use but this does not affect any right or remedy which exists apart from that Act. Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof. |
